  1.      Acceptance of the terms.

 

The customer confirms have acquainted, when ordering, the present and particular general conditions of sale stated here and expressly declares to accept them unreservedly.

The present general conditions of sale, govern the contractual relationship between Caramel & Cie and the customer, both parts accept them unreservedly. Those general conditions prevail on any other condition contained in any other document, except exemption preliminary, expressed and written.

 

  1.      Order

 

Automatic recording systems are considered as being worth proof, of the nature, the content and the date of the order.

Caramel & Cie confirm the acceptance of the order to the customer by e-mail that the hereinafter has communicated.  The sale will only be concluded after the confirmation of the order. Caramel & Cie reserve the right to cancel or refuse any order from a customer with whom there is a dispute concerning payment of a previous order. Information provided by the buyer, when orderingcommits him: in the case of error in the addressee's details of the recipient, the seller could notbe held responsible for failure in delivery.

 

  1.      Delivery

 

Caramel & cie undertakes to ship your order within 24 hours from Monday to Friday.

If it is passed before noon, then it will be processed and shipped the same day.

Any order placed after Friday 2pm will be shipped on Monday.

For deliveries out of France, the customer undertakes to pay all taxes due on the import of products, customs duty, value added tax, and any other taxes due under the laws of the country in which the order is received. All orders placed are intended for the personal use of customers, customers or recipients of products refrain from any partial or total resale of the products. Caramel & Cie is released from any legal liability if the taxes are not paid by the customer.

Depending on the customer's choice, delivery can be made, in France, by:

- Colissimo without signature in 48 hours after shipment

- Mondial Relay in 3 to 4 days after shipment

- TNT for express delivery within 24 hours after shipment

Or abroad by:

- Colissimo International for a delivery time of 3-4 working days in Europe, 5-6 for the rest of the world

- Mondial Relay for Belgium, Spain and Luxembourg

The delivery rate is calculated according to the weight and place of delivery. The price will be indicated to you before validation of your order.

  1.      Retraction: 

 

In case of an apparent defect, the buyer benefit from the right of returning it the conditions laid down in this document.

The client has 14 days (from the reception of the articles) to do a return request. In case of exchange or reimbursement, send back (the) new article(s) in their original packaging, intact, accompanied of all the eventual accessories, instruction notice and documentation to the following address:

In case of exercise of the right of retraction, Caramel & Cie is required to reimburse the amounts paid by the customer to the exception of the cost of return. The reimbursement will be made with the next 15 days maximum.

  1.      Price

 

­The price is expressed in Euros or in US dollars depending on your geographical zone.

The price indicated on the product description doesn’t include the shipping.

The price indicated on the order confirmation is the definitive price, expressed all taxes included and including the VAT for France and UE countries. This price includes product price, handling cost, packaging and product conservation, shipping costs and installation fees.

 

  1.      Payment

 

The price invoiced with the customer is the price indicated on the order confirmation addressed by Caramel & Cie

The product price is payable in cash the effective day of the order.

For the security of your payments we use Atos SIPS Worldline by Société Générale, one of the solutions the most reliable

 With this system, your payment by card will be made directly on the secured server of our bank for our account.

 In no way your card number, or any other confidential data attached to it, will be communicated to us. Exchanges are encrypted through the secure platform is certified Atos SIPS, the highest safety standards in the payment industry.

Furthermore, Caramel & cie retains the right to refuse any order from a customer with whom there is a dispute.

The present contract is submitted to the French Law. Caramel & cie cannot be held responsible for any natural damages, immaterial or corporal, which may result from a poor functioning or inadequate use of the commercialized products. The responsibility of Caramel & Cie will be, at all events, limited to the amount of the order. In case of difficulty encountered in applying the present contract, the buyer has the possibility, before any justice action, to research an amicable solution particularly with the help of:

-       Professional association of the branch, a consumer association or any other council of his choice.  It is reminded that the research of an amicable solution doesn’t interrupt the “brief delay” of the legal guarantee or the contractual guarantee. It is reminded that as general rules and subjected to the agreement of Courts, the respect of provisions of the present contract with the contractual guarantee suppose that the buyer honors its financial implication towards the seller.

The complaints or the contesting will always be received with attentive benevolence, the good faith being always presumed at the one who makes the effort to expose his situations. Inthe case of litigation, the customer should first contact the company to try and obtain an amicable solution.

 

  1.      Guarantee

 

The responsibility of Caramel & Cie is systematically limited to the value of the product blamed, value on its date of sale and this without possibility of recourse towards the mark or the Producing Company of the product.

 

In any assumptions, the customer benefits of the legal guarantee of the hided defects. (Art.1625 and following of the civilian code). Provided the purchaser proves the latent defect, the vendor is, legally obliged to remedy any consequences; if the purchaser goes to the Courts then that must be within a "short period" time from the moment the latent defect has been discovered (art 1648 of the civilian code)
